1. About EPYVIO

EPYVIO is an online telemedicine platform operated by MEDUMIX S.R.L., a Romanian limited liability company registered at the Oficiul Registrului Comerțului de pe lângă Tribunalul Hunedoara under J2021001300205, CUI 44820533. The platform connects patients with licensed healthcare professionals for private online consultations via video call, messaging, and document sharing. EPYVIO is a technology platform — not a healthcare provider. Doctors using EPYVIO are independent medical professionals who are solely responsible for the medical advice, diagnoses, and treatment they provide.

Regulatory framework (Romania): The platform operates within the Romanian telemedicine regulatory framework — Legea nr. 95/2006 art. 30, OUG nr. 196/2020, and the methodological norms approved by HG nr. 1133/2022. Doctors licensed in Germany or Austria practice under their respective national frameworks (§630a BGB + MBO-Ä §7 Abs. 4 for Germany; §49a Ärztegesetz for Austria).

2. Eligibility

You must be at least 18 years old to create an account. Patients under 18 may use the platform through a parent or legal guardian's account using the family member feature.

Doctors must hold a valid medical license (Approbation) issued by a German Landesärztekammer or an equivalent EU authority recognized in Germany. All doctor profiles are verified before becoming publicly visible.

3. Nature of Service — Private Medical Treatment

All consultations on EPYVIO are private medical treatments (Privatbehandlung). Services are billed according to the German Medical Fee Schedule (Gebührenordnung für Ärzte — GOÄ), as the treating physicians are established in Germany.

This applies regardless of the patient's location or nationality. Whether you are in Germany, Romania, Austria, or elsewhere, the consultation is governed by the GOÄ because the doctor practices from Germany.

Important: Consultations on EPYVIO are not covered by Romanian statutory health insurance (CNAS), German statutory health insurance (GKV), or any other public insurance scheme. You are booking as a self-paying patient (Selbstzahler).

4. Fees and Payment

No payment is taken at the time of booking. Booking a slot reserves the appointment only — no card is charged and no advance payment (Vorkasse) is required.

Consultation fees are set by individual doctors. Any price shown before booking is an approximate guideline; the amount actually due is determined by the doctor's GOÄ invoice after the consultation. EPYVIO does not process, collect, or hold consultation payments — payment is arranged directly between you and the doctor.

GOÄ Invoice: After your consultation, your doctor will generate a GOÄ-compliant invoice listing the specific medical services provided and issue it to you directly (also available in your EPYVIO account under Documents). You settle this invoice with the doctor by the means stated on it. If you have private health insurance (PKV), you may submit this invoice for reimbursement.

5. Cancellation

Because no payment is taken at booking, you may cancel a confirmed appointment free of charge. As a courtesy, please cancel at least 24 hours before the scheduled time so the slot can be reoffered.

No invoice is issued for a consultation that does not take place. A GOÄ invoice is only ever issued for services actually rendered.

If the doctor cancels, fails to attend, or the consultation could not take place due to technical issues on the platform side, you may reschedule and are not billed.

5a. Statutory Right of Withdrawal (OUG 34/2014 / Directive 2011/83/EU)

As a consumer, you have the right to withdraw from the consultation contract within 14 calendar days of booking, without giving any reason (OUG nr. 34/2014 art. 9).

Important exception: By booking a consultation scheduled within the 14-day period and giving express consent that the service begin before the withdrawal period expires, you acknowledge that once the consultation has been fully performed, you lose the right of withdrawal (OUG 34/2014 art. 16 lit. m — services fully performed with the consumer's prior express consent).

To exercise the right of withdrawal before the consultation takes place, send a notification to legal@epyvio.de. As no payment is taken at booking, no refund is necessary; if the consultation has not taken place, no invoice will be issued.

This statutory right applies in parallel with the cancellation rules in §5 — whichever is more favourable to you applies.

6. Video Consultations (Videosprechstunde)

Video consultations are conducted via encrypted WebRTC technology hosted on EU servers. All media streams are encrypted (DTLS-SRTP). No video or audio recordings are made or stored by the platform.

You are responsible for ensuring a stable internet connection and a private environment during the consultation. The doctor may end the consultation if the connection quality is insufficient for proper medical assessment.

Recording is strictly prohibited. Neither the patient nor the doctor may record (audio, video, or screen capture) a consultation without prior written consent from the other party. Violating this prohibition constitutes an infringement of private life under art. 226 Cod Penal român, §201 StGB (Germany) and §120 StGB (Austria), and may also give rise to civil liability for damages.

7. Medical Disclaimer

EPYVIO does not provide medical advice. All diagnoses, prescriptions, and treatment plans are the sole responsibility of the consulting doctor.

Telemedicine has limitations — not all conditions can be diagnosed or treated remotely. Your doctor may recommend an in-person visit if necessary.

In case of a medical emergency, call 112 (EU) or your local emergency services immediately.

8. Data Protection

We process your personal and health data in accordance with the EU General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG). For details, see our Privacy Policy.

Medical data is encrypted at rest (AES-256-GCM) and in transit (TLS). All data is stored on EU servers in Germany.

9. Intellectual Property

All content on the platform, including design, logos, and software, is owned by MEDUMIX SRL. Medical documents generated during consultations belong to the respective doctor and patient.

10. Limitation of Liability

EPYVIO provides the platform "as is" and does not guarantee the availability or quality of medical services provided by doctors. We are not liable for medical outcomes resulting from consultations.

Our liability is limited to the platform functionality. We are not liable for damages arising from the doctor-patient relationship.

Force majeure and fortuitous events (art. 1351 Cod Civil). The parties shall not be liable for failure to perform caused by force majeure or fortuitous events, including without limitation: unavailability of the user's or our upstream providers' internet networks, cyberattacks, power outages, natural disasters, acts of public authorities, general strikes, or interruptions of essential technical providers (Hetzner, LiveKit, Stripe, Brevo). The affected party shall notify the other within 5 days and offer free rescheduling or a full refund.

11. Governing Law and Jurisdiction

These terms are governed by Romanian law, as MEDUMIX SRL is a Romanian legal entity. For consumers, the mandatory consumer protection provisions of their country of residence remain unaffected.

Forum. Disputes are decided by the Romanian courts having jurisdiction at the seat of MEDUMIX SRL (Tribunalul Hunedoara or, where applicable, Tribunalul București). In accordance with art. 17 and 18 of Regulation (EU) 1215/2012 (Brussels I bis), consumers may also bring claims before the courts of their member state of residence (Germany: Amtsgericht/Landgericht competent; Austria: Bezirksgericht/Landesgericht).

Irreducible consumer rights. No provision of these Terms shall be interpreted as limiting rights conferred on consumers by mandatory legislation — Romanian (OG nr. 21/1992, OUG nr. 34/2014, Legea nr. 365/2002, Legea nr. 296/2004 — Codul consumului), German (BGB §§305–310, VSBG), or Austrian (KSchG). Consumers cannot waive rights granted by law, and any contrary clause is deemed unwritten (art. 78 Legea 296/2004; Directive 93/13/EEC on unfair terms).

12. Changes to These Terms

We may update these terms from time to time. Significant changes will be communicated via email. Continued use of the platform after changes constitutes acceptance of the updated terms.

14. Dispute Resolution / Soluționarea litigiilor

14.1. Direct contact: Complaints should be addressed first to legal@epyvio.de. We respond within 30 calendar days.

14.2. Alternative dispute resolution (RO consumers) — OG nr. 38/2015: If a dispute cannot be resolved directly, consumers resident in Romania may use the Alternative Dispute Resolution procedure:

14.3. Hinweis für Verbraucher in Deutschland (VSBG): Wir sind nicht bereit oder verpflichtet, an Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.
